Conditional Fees

Uplift v Care and Consideration 

Conditional fees are an additional charge over and above fees payable in a “no win no fee” claim. There are two types:

  1. Uplift fee; and
  2. Care and consideration fee

An uplift fee is a generic fee placed on all “no win no fee” claims as a way for the firm to balance the risk of potentially losing the case (and the fees along with it). 

This fee can be up to 25%. 

The care and consideration fee is determined based on the unique circumstances surrounding a case. If the case is particularly complicated and requiring highly experienced skills, the firm may charge a fee based on those circumstances. 

This fee can be up to 30%.

Some firms charge both fees. We are fiercely against this way of charging at Bowes Legal and believe it is unethical to do so. 

Disbursements

Disbursements are the outlays that a law firm has spent pursing the claim (i.e. for medico-legal reports, medical records, barrister fees and so on). 

At Bowes Legal, we pay for your disbursements upfront and they are taken out of your settlement at the completion of the matter. 

Unlike our competitors, we think before we incur these expenses, we speak with you first, that way when your matter comes to an end, you do not get any nasty surprises at the amount of money spent on disbursements.
